“Adventure Underwater is a company that is independent of HPB but offers services that are exclusive to HPB’s Bondholders. Except in the case of Packages sold to EU residents, HPB are not responsible for any acts and/or omissions of Adventure Underwater, their employees, agents, servants or representatives and HPB will accept no responsibility or liability in respect of either person or property for any loss, damage, injury, accident, delay or irregularity however occasioned, sustained or suffered during or on any such service. For the avoidance of doubt, this clause does not seek to exclude liability for death or injury to the extent caused or contributed to by the negligence of HPB or its employees.”
